Permission to Work on a Student Visa

As of July 1, 2016, there are new rules for student visas to Australia. The old Subclasses 571 through 576 have been put together under Subclass 500. According to the new rules, students who go to Australia on a Visa Subclass 500 can work up to 40 hours in a fortnight while their classes are in session and as many hours as they want when their classes aren’t in session (during breaks). The only provision is that the student cannot start working until the course commences.

A fortnight is also a 14-day period that starts on a Monday and ends on the Sunday of the next week. The hours can be split up however the student wants. So, this is an example of how much work international students can do in Australia: a student may work 10 hours the first week and 30 hours the second week, or 15 and 25 hours, respectively. Students must remember that in the above example if the student works 30 hours in week 2, he or she can only work 10 hours in the following week. Otherwise, the condition of 40 hours in a fortnight would be broken, which can lead to Visa cancellation. Ideally, a student looking for continuous part-time work must limit their work to about 20 hours a week. So, this is how much a student from outside Australia can earn by working there.

A few things to remember:

1. Students can only do work once class starts. For example, if your class started in January 2021 and you arrived in Australia in December 2020, you will be able to get a job once your class starts.

2. This limit does not apply if casework is a normal part of the curriculum for your course. Most of the time, this is true for integrated courses that require internships.

3. Students in the Postgraduate Research Sector can work as many hours as they want once their research or doctoral thesis work starts. Also, if the student has signed up for any prerequisite courses, they can work 40 hours every two weeks, as stated above.

4. Students who finish their required studies in Australia can apply for a Post-Study Work Permit through the Graduate Stream. Students in ELICOS, on the other hand, can’t apply for a Post Study Work Permit in Australia.

*Keep in mind that students applying under the category “Post Graduate Research Sector” who are taking a preparatory course are only allowed to work 40 hours in two weeks while they are taking the course. The student can work for as long as they want once the Research Course starts.

Remember that if you want to work part-time, you’ll need to apply for and get a Tax File Number. If you are an international student with a foreign passport, you can use their official website to apply for a TFN.
